These Terms of Service govern access to and use of Showory, including studio workspaces, galleries, client delivery, documents, payments, storage, marketing tools and related services.
1. Agreement to these terms
By creating an account, starting a trial, purchasing a subscription, or using Showory, you agree to these Terms of Service and our Privacy Policy. If you use Showory for a studio, company or other organization, you confirm that you have authority to accept these terms for that organization.
2. The Showory service
Showory is a software platform for photographers and photography businesses. Features may include galleries, client and project records, contracts, quotations, invoices, receipts, payment tools, expenses, mileage, reports, marketing materials, file storage and related workflow tools. Features may change as the service develops, provided that we do not intentionally remove paid core functionality without reasonable notice where practical.
3. Accounts and security
You are responsible for maintaining accurate account information, safeguarding your sign-in credentials, and controlling access to your studio workspace. You must notify Showory promptly if you believe your account or client data has been accessed without authorization. You may not share access in a way that bypasses plan limits, security controls or user-role restrictions.
4. Your content and client data
You retain ownership of photographs, videos, documents, logos, client information and other content you upload or create through Showory. You grant Showory a limited licence to host, process, transform, transmit, back up and display that content only as reasonably necessary to operate and improve the service, provide requested features, maintain security, and comply with law.
You are responsible for having the rights, permissions and lawful basis needed to upload, store and share your content and client information. Showory does not obtain ownership of your photography simply because it is uploaded to the platform.
5. Acceptable use
You may not use Showory to violate law; infringe intellectual-property, privacy or publicity rights; distribute malware; attempt unauthorized access; bypass payment, storage or security limits; interfere with the service; impersonate another person; or upload content that you do not have the right to use. We may restrict or suspend access where reasonably necessary to protect users, clients, infrastructure or the integrity of the service.
6. Subscriptions, trials and billing
Paid plans are billed according to the price and billing interval shown when you subscribe. Unless otherwise stated, subscriptions renew automatically until cancelled. A free Showory trial is one-time, is currently limited to seven days and up to 5 GB of trial storage, and does not restart after it expires, after a paid plan is cancelled, or after an operational account is deleted and recreated with an email that has already used a trial.
If no paid plan is activated before the trial ends, normal studio access may be locked. Showory may retain the inactive trial workspace for up to 30 days after the trial ends so the owner can activate a paid plan. If no paid plan is activated by the retention deadline, Showory may permanently delete the inactive trial workspace, uploaded files, profile, and authentication account. Paid-account cancellation follows the separate recovery period described in the Refund & Cancellation Policy.
Taxes may be added where required. You are responsible for keeping billing information current. Subscription cancellation and refund rules are described in our Refund & Cancellation Policy.
7. Studio-to-client payments
Where Showory enables a studio to accept payment from its own clients, the studio remains the seller of its photography services. Payment processing may be provided by Stripe or another payment processor. Showory is not a party to the underlying photography contract between a studio and its client unless expressly stated otherwise.
For client card payments of 100.00 or more in the invoice currency, Showory deducts a flat platform fee of 3.00 in that currency from the studio's payment. Stripe or another payment processor may charge its own separate processing fees. The Showory platform fee does not apply to Showory subscription payments. If a client card payment is refunded, the Showory platform fee is returned proportionally to the refunded amount.
8. Third-party services
Showory relies on third-party infrastructure and service providers for functions such as hosting, authentication, storage, email delivery and payments. Their services may be subject to separate terms and availability. We choose providers with the goal of operating Showory securely and reliably, but no internet service can guarantee uninterrupted availability.
9. Availability, backups and changes
We work to keep Showory available and protect stored information, but the service is provided on an “as available” basis. Temporary interruptions may occur for maintenance, provider outages, security incidents or circumstances outside our reasonable control. You should keep independent copies of irreplaceable original photography and business records.
10. Intellectual property
Showory, its software, interface, brand, logos, design system and original platform content are owned by or licensed to Showory and are protected by applicable intellectual-property laws. These terms do not give you the right to copy, resell, reverse engineer or create a competing service from protected Showory materials except where applicable law expressly permits it.
11. Suspension and termination
You may stop using Showory and cancel a paid subscription in accordance with the Refund & Cancellation Policy. We may suspend or terminate access for material breach, fraud, abuse, security risk, unlawful use, persistent non-payment, or expiry of a free trial without an active paid plan. Where practical and safe, we will provide notice and a reasonable opportunity to address the issue before permanent termination.
12. Disclaimers and liability
To the maximum extent permitted by law, Showory is provided without guarantees that it will be error-free or continuously available. Showory is not responsible for a studio’s photography services, client promises, tax filings, legal documents, business decisions, or content uploaded by users. Nothing in these terms excludes rights or remedies that cannot legally be excluded.
To the maximum extent permitted by law, Showory will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, goodwill or business opportunities arising from use of the service. Any limitation applies only to the extent enforceable under applicable law.
13. Governing law
These terms are governed by the laws of British Columbia and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Any mandatory consumer or statutory rights that apply to you remain unaffected.
14. Changes to these terms
We may update these terms as Showory evolves or legal requirements change. The current version and effective date will be posted here. For material changes affecting paid users, we will provide reasonable notice where practical.
